In den USA steht ETS bereits seit 2002 in der Kritik, weil die Organisation einerseits als gemeinnützig anerkannt und so von der Steuer befreit ist , andererseits aber hohe Gehälter und Bonuszahlungen bekannt geworden sind, seitdem Kurt Landgraf 2001 CEO wurde. Die Bonuszahlungen für Führungskräfte befanden sich in seinem ersten Jahr in derselben Größenordnung wie deren Jahresgehälter, während im akademischen und Stiftungsbereich sonst nur fünf bis zehn Prozent üblich sind. Einmalzahlungen von bis zu 366.000 US-Dollar wurden an 15 Angestellte gezahlt, Landgraf selbst bekam für seine ersten zehn Monate 800.000 US-Dollar. TOEFL ITP (“ITP” stands for “Institutional Testing Program”) tests are paper-based and use academic content to evaluate the English-language proficiency of non-native English speakers. The tests use new and previously administered TOEFL test questions and are used for placement, progress, evaluation, exit testing and other situations.
TOEFL Junior Tests

TOEICとの対比
TOEFL と同じく ETS が TOEIC も開催している。TOEFLは、英語圏の高等教育機関における英語コミュニケーション能力（講義の受講、学術書の講読、ディスカッションへの参加等）を問うており、入学者選抜のための基準として用いられている。これに対し TOEIC はビジネス英会話および日常会話を主眼にしている。
